Does a husband or wife always “get half?”
No and here’s the short explanation.
Every state’s laws should be reviewed for your personal situation.
But in the state of Louisiana at the time of writing, the answer is “No.” both parties do not innately share ownership in real estate.
It’s a misconception created by nightmare scenarios in explosive and high profile divorces.
But besides “divorce,” there are other reasons married people choose to not share ownership in property, so let’s explore how this works and why people do it.

At closing day, as you sign to secure ownership and get your keys, you can choose to document that one person in the couple has 100% ownership in the property. Some of my married clients have opted to do this.
So why do some couples choose this? Are they focusing on “divorce?”
Not at all. But if divorce happens, that is one added benefit since there’s not need to fight over who owns the property.
One example is a couple who both own their own businesses. To protect the home from risks associated by the husband’s riskier business venture, the wife secured full ownership.
